1. DEFINITIONS
"Company" means Wind Rises Water Sports Training Services L.L.C, a Limited Liability Company – Single Owner incorporated under the laws of the Emirate of Dubai, UAE, with Trade License No. 1118837 issued by the Department of Economy and Tourism, Dubai.
"Client" means any individual, corporate entity, or group purchasing or booking any Service offered by the Company.
"Service(s)" means any water sports training session, sailing experience, racing event, corporate sailing event, sailing pass, gift card, or any other activity organised or provided by the Company.
"Booking" means a confirmed reservation for a Service, whether made via the Company website, WhatsApp, third-party platform (Platinumlist, Booking.com), or direct communication.
"Venue" means Rashid Yachts & Marina, Emaar, Dubai, UAE, or any other location designated by the Company.
"Participant" means any individual who physically takes part in a Service, which may or may not be the same person as the Client.
"Force Majeure" means any event beyond the reasonable control of the Company, including but not limited to adverse weather, acts of God, government directives, maritime authority orders, mechanical failure of vessels, or any other circumstances rendering the safe operation of Services impossible.
2. SCOPE AND ACCEPTANCE
2.1. These Terms govern all Services provided by the Company and form a binding agreement between the Company and the Client upon confirmation of any Booking.
2.2. By completing a Booking, the Client confirms they have read, understood, and accepted these Terms on behalf of themselves and all Participants included in the Booking.
2.3. These Terms supersede any prior verbal or written representations made by Company staff unless expressly confirmed in writing.
2.4. The Company reserves the right to amend these Terms at any time. The version in force at the time of Booking shall apply to that Booking.
3. BOOKING AND PAYMENT
3.1. Booking Confirmation A Booking is confirmed only upon receipt of full payment or an agreed deposit, and issuance of written confirmation by the Company or its authorised platforms. Verbal agreements or provisional holds do not constitute a confirmed Booking.
3.2. Pricing All prices are in UAE Dirhams (AED) and inclusive of 5% VAT in accordance with UAE Federal Law No. 8 of 2017. Prices are subject to change without notice for future bookings.
3.3. Payment Methods Payment is accepted via the Company website, Platinumlist, Booking.com, or as otherwise agreed in writing. Corporate clients may be invoiced subject to prior written agreement. Itemised receipts detailing service amount and VAT are available upon request.
4. CANCELLATION AND RESCHEDULING POLICY
4.1. Cancellation by the Client — More than 48 hours before the session: full refund or free rescheduling. — Between 24 and 48 hours before: 50% refund or free rescheduling (subject to availability). — Less than 24 hours before: no refund. Rescheduling subject to availability and a rescheduling fee. — No-show without prior notice: no refund. — Sailing Passes and Gift Cards are non-refundable after purchase but transferable to another person.
4.2. Cancellation by the Company The Company may cancel or reschedule any Service due to Force Majeure, unsafe weather, insufficient group size, mechanical issues, or any directive from the Dubai Maritime Authority. The Client will be offered a full refund or rescheduling at no additional cost. The Company is not liable for indirect costs (travel, accommodation, etc.) incurred by the Client.
5. SAFETY, HEALTH, AND ELIGIBILITY
5.1. Minimum age for participation is 15 years. Participants under 18 must be accompanied by a responsible adult and present written parental consent prior to participation.
5.2. The Company does not accept participation by individuals who are pregnant or have sustained recent injuries or medical conditions that may be aggravated by physical activity on water.
5.3. It is the Client's sole responsibility to disclose any relevant medical conditions or physical limitations affecting any Participant at the time of Booking.
5.4. Life jackets are mandatory for all Participants at all times on the water.
5.5. All sessions are supervised by a certified instructor. Participants must follow all safety instructions given by the instructor and Company staff.
5.6. The Company reserves the right to refuse participation to any individual under the influence of alcohol, narcotics, or any impairing substance.
5.7. Consumption of alcohol or food is prohibited on board the vessel.
6. LIABILITY AND INDEMNITY
6.1. Participation in water sports activities involves inherent risks. The Client and all Participants acknowledge and voluntarily accept these risks.
6.2. The Company, its directors, instructors, and staff shall not be liable for personal injury, death, loss, or damage to property suffered by any Participant, except where such loss results directly from the gross negligence or wilful misconduct of the Company.
6.3. The Company's total liability for any claim shall not exceed the total amount paid by the Client for the specific Service giving rise to the claim.
6.4. The Client agrees to indemnify and hold harmless the Company against any claims, losses, costs, or damages arising from breach of these Terms or applicable law.
6.5. The Company maintains appropriate insurance as required by the Dubai Maritime Authority.
7. CLIENT AND PARTICIPANT CONDUCT
7.1. All Participants must behave safely and respectfully towards Company staff, instructors, other participants, and third parties at the Venue.
7.2. The Company reserves the right to remove any Participant from a session without refund if their behaviour poses a safety risk or is disruptive, aggressive, or offensive.
7.3. Participants must comply with all rules and regulations of Rashid Yachts & Marina.
7.4. Appropriate footwear (closed-toe, non-marking), sunscreen, and sunglasses are strongly recommended. The Company is not responsible for injury resulting from failure to follow dress guidance.
8. CORPORATE EVENTS
8.1. Corporate bookings are subject to a separate quotation and may include specific terms agreed in writing.
8.2. A deposit of 50% of the total event value is required to confirm a corporate Booking. The balance is due no later than 5 business days before the event.
8.3. Cancellation of a confirmed corporate event less than 7 days before the event date results in forfeiture of the full deposit.
8.4. Custom services (branded sails, catering, photography, DJ, VIP transfers) are subject to additional fees and separate supplier terms.
8.5. Minimum group size and maximum capacity are as specified in the relevant quotation.
9. GIFT CARDS AND SAILING PASSES
9.1. Gift Cards are valid for 12 months from purchase. Expired cards cannot be extended, refunded, or redeemed.
9.2. Sailing Passes are personal but transferable to a third party with written notice to the Company. Passes have no cash redemption value.
9.3. Gift Cards and Passes cannot be redeemed for cash or combined with other promotional offers unless expressly stated.
10. PHOTOGRAPHY AND INTELLECTUAL PROPERTY
10.1. The Company may photograph or film sessions for promotional and marketing purposes. By participating, Participants grant the Company a non-exclusive, royalty-free licence to use such materials.
10.2. Any Participant who does not consent to being photographed or filmed must notify the Company in writing before the session.
10.3. All content, branding, logos, and materials produced by the Company remain its exclusive intellectual property.
11. DATA PROTECTION AND PRIVACY
11.1. The Company collects and processes personal data in accordance with applicable UAE data protection legislation.
11.2. Personal data provided during Booking is used solely for service delivery, safety management, and Booking-related communications.
11.3. The Company does not sell, rent, or share personal data with third parties except where required for service fulfilment or by law.
11.4. Clients may contact event.dubai@windrises.com to request access to, correction of, or deletion of their personal data.
12. GOVERNING LAW AND DISPUTE RESOLUTION
12.1. These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates.
12.2. Any dispute shall first be subject to good-faith negotiation between the parties.
12.3. If unresolved within 30 days, the dispute shall be referred to the competent courts of Dubai, UAE.
13. REGULATORY COMPLIANCE
13.1. The Company operates under the jurisdiction of the Dubai Maritime Authority and the Department of Economy and Tourism, Dubai, and conducts all activities in compliance with their regulations.
13.2. Licensed under License No. 1118837 for Water Sports Training Services and Sport Tournaments Organizing Services.
14. MISCELLANEOUS
14.1. If any provision of these Terms is unenforceable or invalid, the remaining provisions continue in full force.
14.2. Failure by the Company to enforce any provision shall not constitute a waiver of its right to do so in the future.
14.3. These Terms constitute the entire agreement between the Company and the Client, superseding all prior discussions and representations.
